Creditors’ Rights At STF&H
The Firm represents its clients in bankruptcy litigation, which maximizes creditors’ recovery. We aggressively represent creditors in both corporate and individual bankruptcy matters and have extensive experience prosecuting fraud cases against debtors in bankruptcy adversary proceedings. Where a debtor obtains credit through fraud or misrepresentation on a financial statement, the creditor may be entitled to have its receivable deemed non-dischargeable in bankruptcy, thereby allowing the creditor to continue collection efforts against the debtor. The Firm has also successfully defended creditor clients against lawsuits charging violation of the automatic stay provisions contained in the Bankruptcy Code.
